What Benefits Are Available Under The NSW Workers’ Compensation Scheme?
Under the NSW workers’ compensation scheme, an injured worker is entitled to three different types of workers’ compensation benefits:
- Weekly compensation for time off work as a result of their injury.
- Reasonably incurred medical expenses resulting from any physical or psychological injuries suffered at work.
- A lump sum payment for physical or psychological impairment resulting from a physical or psychological injury.
Weekly benefits are typically paid for up to two and a half years. These payments compensate you for the time you miss from work as a result of an injury suffered at work, on break from work, on a journey to and from work, or during work-related travel.
You may also be entitled to “make up pay” for an additional two and a half years if you are able to return to work, but earn less income than you earned prior to being injured.
Medical expenses are typically paid for up to two years longer than the duration of your weekly compensation payments. If your injury results in at least 20% impairment to your whole person, you may be entitled to related medical expenses for the rest of your life.
Lump Sum Payment
Your are entitled to a lump sum benefit payment if your injury leaves you with a physical (at least 11%) or psychological (at least 15%) impairment to your whole person.
If your impairment is more than 20% to your whole person, you can receive weekly benefits for up to 5 years.
If your impairment is at least 30% of your whole person, you can receive weekly benefits until you reach the age of retirement.
